Booking Terms and Conditions
Please read these Terms and Conditions carefully as they are legally binding and constitute an integral part of your agreement with Panorama (or Primavera) Villa
1. BOOKING
1.1 These Terms and Conditions and the Booking Form contain all the provisions of your present booking. They apply equally to the Party leader and to all the persons named in the Booking Form.
1.2 Your signature of this Booking Form duly completed constitutes full acceptance of these Booking Terms and Conditions and Booking Form information and details.
1.3 Your booking concerns accommodation in a furnished luxury property with weekly cleaning and change of linen and towels (pool towels excluded).
2. THE PROPERTY
The Property Owner, or the “Manager” (person duly authorized by the Property Owner) visits and checks each property regularly. The information about each property in our page in Owners’ Direct website is accurate, however, we will inform you as soon as possible of any major change to the property(if any) that may make the accommodation different to what is described in the site.
3. PAYMENTS
Payments should follow the Payment Schedule on page 1 of this document. If the payments in the Payment Schedule are not received by their respective due dates, or you violate any other provision of the Booking Documents, the Owner reserve their right to immediately terminate this agreement, cancel your booking and refuse you access to the Property. In this event, the cancellation policy as per article 6 of this document shall apply.
4. BOOKING CONFIRMATION DETAILS
Once the Property Owner has received full payment according to the Payment Schedule, you shall receive a Payment Receipt /Booking Confirmation by email from the Property Owner / Manager. Please read this confirmation carefully and contact the Property Owner / Manager immediately if the information obtained therein is incorrect or incomplete.
The Property Owner shall not be obliged to rectify any errors or omissions that are reported more than 24 hours after the transmission of the confirmation.
5. CHANGES and CANCELLATION BY YOU
5.1. If you wish to make any changes to your confirmed booking, you must notify the Property Owner in writing as soon as possible. We shall make every attempt to meet your request, but cannot guarantee compliance with such requests.
5.2. If you wish to cancel your booking, you must inform the Property Owner immediately in writing. The following cancellation policy shall apply:
If Cancellation is made more than 10 weeks before first day of rental then full refund, excluding the necessary bank charges.
Between 5 -10 weeks before 1st day of rental, then the Initial Payment will be refunded by 50%.
Less than 5 weeks before first day of rental then no refunds
6. CANCELLATION OR CHANGES BY THE PROPERTY OWNER
In the exceptional circumstance where we can no longer provide you with the Property booked or the same Rental Period (for reasons other than Force Majeure), you will have the choice between one of the following options:
(i) Accept an alternative property of equivalent rating for the same Rental Period;
(ii) If neither option above is possible, or if you do not wish to be transferred, we will cancel the booking and refund any amounts paid to us. We shall not be held liable for any additional cancellation charges.
7. CHECK-IN/CHECK-OUT
Please observe the check-in time and check-out times, as listed. We will try to be flexible and to accommodate requests for early check-ins and late check-outs (based also on the whatever deartures and arrivals of other guests, within the same date), but cannot guarantee them.
8. USE OF THE PROPERTY
8.1. Only those persons stipulated on Page 2 of this document may occupy the Property. The number of guests staying overnight in the Property must not exceed the Maximum Occupancy indicated on Page 1. In the event that the number of guests exceeds the Maximum Occupancy, we reserve the right to ask these surplus guests to vacate the Property immediately.
8.2. You shall use the Property only for the purpose for which it has been rented to you (personal lodging). It is forbidden to use the premises for any kind of commercial use during the rental (photo shoots, seminars), and/or to hold entertainment parties or functions involving a large number of invitees, unless expressly agreed in writing by the Property Owner. Should you make an unauthorized use of the Property in such a way, we reserve the right to ask all guests to vacate the Property immediately.
8.3. You must not sublet the Property in any circumstance whatsoever.
8.4 Photographs taken at the Property can not be used or sold for profit without written authorization by the Property Owner.
9. GUEST INJURY DISCLAIMER
The Property Owner , or Manager cannot be held liable towards you, the Occupants or your guests for any accident or injury occurred during your stay, under any circumstances.
10. OWNER’S RESPONSIBILITY
10.1 The Property Owner / Manager cannot be held liable towards you, the Occupants or your guests for any loss or misplacement of valuables left in the Property during your stay.
10.2 The Property Owner cannot be held liable towards you, the Occupants or your guests for any failure that is:
(a) Attributable to you or a member of your party;
(b) Attributable to a third party unconnected with the provision of the services to you, and is unforeseeable or unavoidable;
(c) Attributable to our agents, subcontractors and suppliers and their staff whilst acting outside the scope of their employment;
(d) Due to Force Majeure;
(e) Due to information, however obtained, from outside sources such as independent third party websites; and/or
(f) consequential loss not directly connected to the contract with us.
10.3 Our liability to you for any loss or damage which you may suffer (to be well supported by documents) is limited to twice the price of your holiday.
This excludes personal injury resulting from the non-performance or improper performance of the services involved in the holiday, in which case our liability shall be limited in accordance with the lowest limit allowed under applicable Greek law. You should be aware that in the area where the Villa is located, there could be found mice, ferrets, snakes especially during the summer period.
Although the Property Owner takes reasonable measures to keep the property area clear of these, you, your children and other occupants and/or guests should take all precautions in this
respect and the Property Owner / Manager cannot be held liable towards you, the Occupants or your guests for any personal injury connected to the above.
11. CHILDREN
The Property Owner will endeavor to inform you of the suitability of the Property for children. Please note that the supervision, safety and behavior of your children is your sole responsibility.
12. PETS
None of our Properties accept pets without previous notice.
13. POOL
13.1 Basic information: net surface of about 60 sq.m. and with varrying depth stating from 0.90 metters (east side) and up to 2.65 m (approx.) in way of its west side, without heating.
Type of water: fresh water (chemically treated to comply with quality standards).
The pool is shared between the 2 villas : Panorama and Primavera.
13.2 Safety
The Villa pool does not have a lifeguard and does not have a shallow end. Also, please note that the pool is ungated, unless you shall fix / install in proper – locked places the existing steel fences.
Children swim at their parents’/guardians’ sole responsibility. The same applies for other occupants or guests who swim at their sole responsibility.
13.3 Pool rules (see also the 2 fixed posters at the pool sides, plus those framed in the villa)
(a) Pool can be used from dawn to sunset. We kindly request that you and your party are considerate of the fact that guests in the other villas that may want to relax or sleep during rest afternoon hours.
(b) Glass items are not allowed in the pool and bbq area for safety reasons.
(c) Children wearing dippers should not enter the pool without a dipper.
(d) A shower is located near the pool should be used before entering the pool water.
14. BEHAVIOR
If in the reasonable opinion of the Property Owner / Manager, or any other person in authority, you or a member of your group behaves in a manner, which causes or is likely to cause a danger, excessive disturbance (i.e. to neighbors), damage to the Property, or acts in breach of any provision of the Booking Documents, then this Agreement may be terminated immediately and you shall be asked to leave the Property.
In this event, you shall not receive any refund and you shall be fully liable for any expense incurred as a result of your behavior or the behavior of the persons in your group.
15. DAMAGES
15.1 The Property shall be checked by the Property Owner / Manager, or any other person in authority before and after the Rental Period.
You shall be liable for any proven damages or losses caused to the Property and its contents. We recommend that you ensure that your insurance policy covers accidental damage to the Property and its contents.
15.2 You shall be liable for all costs related to the loss of any keys provided to you on the first day of the Rental Period.
15.3 You accept to cover the cost of repairing/replacing any proven damages within 7 days of your notification, considering also the security deposit as paid by you.
16. COMPLAINTS & PROBLEMS DURING YOUR STAY – see also ENERGY SAVING RULES
16.1. While the Property Owner / Manager will do everything in his power to provide you with a trouble-free stay, the villa may present malfunctions, just as every house does.
We have set a goal of fixing any problem that arises within 24 hours of it happening, but sometimes this may not be feasible, because of the day of the week, the location of the villa, the availability of technicians, etc.
If you are dissatisfied with the Property or the service of a supplier, please contact us immediately. It is a precondition for any compensation that you inform the Property Owner of all complaints as soon as possible and in any event not after the end of your Rental Period.
16.2 Please note that the villas are located in an area with big problems of drought. We kindly ask you to use water sparingly, especially during the summer months. Electricity and water shortages may and do occur in the area and while we will do everything we can to reestablish supply or to remedy the situation, we can not be held responsible for the inconvenience such shortages create.
17. FORCE MAJEURE
If the execution of this agreement is no longer possible because of force majeure, then any amounts paid but no longer justified, will be reimbursed within 60 days of the event causing the impossibility.
18. INSURANCES
You are responsible for your third party liability and medical repatriation insurances.
19. PARTIAL CANCELLATION
A partial cancellation of the provisions of the Booking Documents pursuant to an agreement between the parties or to the decision of a judicial authority shall not affect the validity of the entire Booking Documents.
20. APPLICABLE LAW AND DISPUTE RESOLUTION
This Booking and the Booking Documents shall be governed by Greek law. In case of dispute arising out of or in connection with this Booking Document, we shall try to resolve this amicably. If the dispute cannot be solved amicably, Greek courts shall have exclusive jurisdiction for the resolution of the dispute.
